By accessing or using the Website, submitting any contact or inquiry form, opting into our SMS messaging program, or otherwise engaging with Emerald Coast Lifestyle LLC through any channel connected to this Website, you agree to be bound by these Terms of Service. If you disagree with any part of these Terms, then you do not have our permission to access or use the Website.
These Terms of Service should be read in conjunction with our Privacy Policy, which is incorporated herein by reference and available on our Website. In the event of any conflict between these Terms of Service and our Privacy Policy with respect to the handling of your personal information, the Privacy Policy shall govern to the extent of the conflict.
1. Acceptance of Terms
By accessing the Website, clicking any "submit," "contact," "opt in," or similar button, or by providing your personal information through any form on the Website, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and all applicable laws and regulations. If you are accessing the Website on behalf of a business entity, organization, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms and that your acceptance of these Terms constitutes the acceptance of the entity.
Emerald Coast Lifestyle LLC reserves the right to modify, update, or amend these Terms of Service at any time, as described in Section 13 of this Agreement. Your continued use of the Website following any update to these Terms constitutes your acceptance of the updated Terms. If you do not agree to any amended Terms, you must discontinue your use of the Website immediately.
These Terms of Service constitute a legally binding agreement between you and Emerald Coast Lifestyle LLC governing your use of the Website and all services, communications, and interactions conducted in connection therewith.
2. Description of Services
Emerald Coast Lifestyle LLC is a real estate and coastal lifestyle company serving prospective home buyers, sellers, and lifestyle enthusiasts along the 30A, Destin, and surrounding Emerald Coast communities of Northwest Florida. Emerald Coast Lifestyle LLC is operated by Grace Akers, a licensed real estate professional affiliated with Rising Star Real Estate, serving the communities of the Florida Panhandle including but not limited to all towns and communities along the 30A corridor, Destin, and the greater Emerald Coast region.
Through the Website, Emerald Coast Lifestyle LLC provides the following services and resources:
Real estate buyer and seller representation and consultation services for properties along the 30A corridor, Destin, and surrounding Emerald Coast communities;
MLS property search tools, listing information, and personalized property alerts based on client-specified search criteria;
Scheduling and facilitation of home showings, buyer consultations, seller consultations, and free discovery calls;
Coastal lifestyle content, beach town guides, local area guides, and community information for the 30A and Destin areas;
Retreat offerings and related lifestyle experiences for interested individuals;
SMS text message communications for opted-in contacts, including marketing messages and service messages as described in Section 4 of these Terms;
Contact and inquiry form submission capabilities for prospective clients and collaborators;
General information about the Emerald Coast lifestyle, real estate market, and local community events.
Emerald Coast Lifestyle LLC reserves the right to modify, expand, discontinue, or otherwise change the services it offers at any time without prior notice, except where advance notice is required by applicable law or by these Terms.
3. User Eligibility
The Website and all services offered by Emerald Coast Lifestyle LLC are intended solely for use by adults and are not directed at, marketed to, or intended for use by children. By accessing the Website or submitting any form, you represent and warrant that you are at least eighteen (18) years of age and that you are of legal age to form a binding contract under applicable law.
The Website and services of Emerald Coast Lifestyle LLC are intended for use by individuals located within the United States of America. Emerald Coast Lifestyle LLC's real estate services are specifically offered in the State of Florida and are subject to Florida real estate licensing law and all applicable federal and state regulations governing the purchase, sale, and brokerage of real property. By using the Website, you represent and warrant that you are a United States resident or that your use of the Website is otherwise permitted by the laws of your jurisdiction.
If you are under the age of eighteen (18), you are not permitted to access the Website, submit any form, or enroll in our SMS messaging program. Emerald Coast Lifestyle LLC does not knowingly collect personal information from individuals under the age of eighteen (18) and does not knowingly permit individuals under the age of eighteen (18) to enroll in our SMS messaging program. If Emerald Coast Lifestyle LLC becomes aware that an individual under the age of eighteen (18) has provided personal information through the Website, we will take appropriate steps to remove such information from our records promptly.
Providing your phone number on our contact forms, registration pages, or intake forms does not, by itself, constitute consent to receive SMS text messages from Emerald Coast Lifestyle LLC. Consent to receive text messages is obtained separately through an affirmative, unchecked checkbox specifically designated for SMS consent at the point of opt-in.
4. SMS and Text Messaging Terms
Emerald Coast Lifestyle LLC operates an SMS text messaging program through which we send marketing and service text messages to individuals who have separately and affirmatively opted in to receive such messages. This section sets forth the complete terms governing our SMS messaging program, including program descriptions, consent mechanisms, message frequency, opt-out procedures, and data handling obligations. Our SMS program is operated in full compliance with the Telephone Consumer Protection Act (TCPA), the regulations of the Federal Communications Commission (FCC), the guidelines of the Cellular Telecommunications Industry Association (CTIA), and all applicable carrier requirements for Application-to-Person (A2P) 10DLC messaging.
4.1 SMS Program Description
Emerald Coast Lifestyle LLC sends two categories of SMS text messages to opted-in contacts: marketing text messages and service text messages. Each category is governed by a separate opt-in consent and is described in full below.
Marketing SMS Messages: Emerald Coast Lifestyle LLC uses marketing text messages to communicate with prospective home buyers and sellers along the 30A, Destin, and surrounding Emerald Coast areas. Specifically, marketing messages are used to share new property listings and MLS updates; to follow up with leads who have inquired about buying or selling a home; to schedule and confirm property showings and consultations; to notify contacts about upcoming local events and community guides; and to provide personalized real estate updates relevant to each client's search criteria. Marketing messages may also be used to share information about coastal lifestyle content, beach town guides, and retreat offerings for interested contacts who have opted in to receive marketing communications from Grace and Emerald Coast Lifestyle LLC. Marketing message types include educational tips and content, special offers and promotions, event invitations, and re-engagement messages. Marketing messages are sent at a frequency of up to 8 messages per month per opted-in contact.
Service SMS Messages: Emerald Coast Lifestyle LLC uses service text messages to send appointment confirmations and reminders for scheduled home showings, buyer and seller consultations, and free discovery calls. Service messages are also used to follow up on submitted contact or inquiry forms, share requested property information or MLS search results, provide status updates during the home buying or selling process, and send time-sensitive notifications such as listing alerts for properties matching a client's specified criteria across 30A, Destin, and surrounding Emerald Coast communities. Service message types include appointment reminders, booking confirmations, and application status updates. Service messages are sent only when triggered by client activity — for example, when a client submits a contact form, books a consultation, requests property information, or completes another qualifying action. There is no predetermined frequency for service messages; the number of messages a client receives is determined entirely by the frequency of their own client-initiated activity.
4.2 Consent Mechanism — How Opt-In Is Obtained
Emerald Coast Lifestyle LLC obtains SMS consent through a clearly displayed, affirmative, and unchecked consent checkbox that is presented to users at the point of opt-in on our Website contact form, CRM forms and funnel pages, and landing page forms. The consent checkbox is never pre-checked. Consent must be actively and voluntarily provided by the individual submitting the form. A mobile phone number field is required on all forms through which SMS consent is collected.
Emerald Coast Lifestyle LLC uses two separate and independent consent checkboxes for its two SMS message categories: one checkbox for marketing SMS messages and one checkbox for service SMS messages. These checkboxes are presented separately and operate independently. A user may opt in to one category without opting in to the other. The existence of two checkboxes ensures that consent for each message type is specific, informed, and separately obtained.
Providing your phone number on our contact forms, registration pages, or intake forms does not, by itself, constitute consent to receive SMS text messages from Emerald Coast Lifestyle LLC. Consent to receive text messages is obtained separately through an affirmative, unchecked checkbox specifically designated for SMS consent at the point of opt-in.
Policy links to our Privacy Policy and these Terms of Service are visible in the footer of all opt-in forms. By checking the SMS consent checkbox and submitting the form, you confirm that you have read and agree to these Terms of Service and our Privacy Policy with respect to SMS communications.
By opting in to marketing text messages from Emerald Coast Lifestyle LLC, you agree to receive marketing text messages as described in Section 4.1 of these Terms at the mobile number you provide, at the frequency specified in Section 4.4. By opting in to service text messages from Emerald Coast Lifestyle LLC, you agree to receive service text messages as described in Section 4.1 of these Terms at the mobile number you provide, triggered by your own client activity as described in Section 4.4.
4.3 Consent Disclosures
The consent disclosures presented to users at the point of opt-in, as displayed on the Website contact form, CRM forms, funnel pages, and landing page forms of Emerald Coast Lifestyle LLC, read as follows:

"By checking this box, I agree to receive service texts from Emerald Coast Lifestyle LLC (e.g., showing confirmations, appointment reminders, listing alerts). Messages sent only when triggered by client activity. Msg & data rates may apply. Reply STOP to opt out. Reply HELP for info. SMS opt-in data is never shared with third parties."
These disclosures are presented to every user prior to the collection of SMS consent and prior to the submission of any form through which an SMS opt-in is processed. No SMS messages will be sent to any individual who has not affirmatively checked the applicable consent checkbox and submitted the form on which that checkbox appears.
4.4 Message Frequency
The frequency of SMS messages sent by Emerald Coast Lifestyle LLC varies by message category as follows:
Marketing SMS messages: Up to 8 messages per month per opted-in contact. This frequency cap applies to all marketing message types, including educational tips and content, special offers and promotions, event invitations, and re-engagement messages. Emerald Coast Lifestyle LLC will not send more than 8 marketing text messages per month to any single opted-in contact.
Service SMS messages: Only when triggered by client activity. Service messages are not sent on a scheduled or recurring basis independent of client action. They are sent exclusively in direct response to a client-initiated action, such as submitting a contact form, booking an appointment, requesting property information, or completing another qualifying activity. The number of service messages a client receives in any given period is determined entirely by the frequency of their own activity and is not subject to a predetermined monthly cap, as each message is individually triggered.
4.5 Message and Data Rates
Message and data rates may apply to all SMS messages sent by Emerald Coast Lifestyle LLC. The rates charged for text messages and data usage are determined by your individual wireless carrier and the specific plan and rate structure under which your mobile device operates. Emerald Coast Lifestyle LLC does not charge any fee for the SMS messages it sends. You are solely responsible for any message or data charges assessed by your wireless carrier in connection with SMS messages you receive from Emerald Coast Lifestyle LLC. If you are uncertain whether message or data charges apply to your wireless plan, you should contact your wireless carrier directly before opting in to our SMS program.
4.6 Supported Wireless Carriers
Our SMS messaging program is supported by major United States wireless carriers, including AT&T, Verizon, T-Mobile, Boost Mobile, MetroPCS, and U.S. Cellular. Coverage and message delivery may vary by carrier and geographic location. Emerald Coast Lifestyle LLC does not guarantee that SMS messages will be delivered successfully on all carriers or in all geographic areas. 4.7 How to Opt Out of SMS Messages
You may opt out of receiving SMS messages from Emerald Coast Lifestyle LLC at any time by replying STOP to any SMS message you receive from us. Upon receiving your STOP request, Emerald Coast Lifestyle LLC will process your opt-out immediately and you will receive a single confirmation message acknowledging that you have been unsubscribed from our SMS messaging program. The opt-out confirmation message will identify Emerald Coast Lifestyle LLC by name and confirm that no further messages will be sent. After your opt-out has been processed, you will not receive any further SMS messages from Emerald Coast Lifestyle LLC unless and until you separately and affirmatively re-enroll in our SMS program by providing new consent.

4.10 SMS Opt-In Data — No Third-Party Sharing
SMS opt-in consent information — including, without limitation, mobile phone numbers collected through our SMS opt-in process, consent records, consent timestamps, and any associated personal information collected in connection with SMS opt-in — is never sold, rented, leased, shared, transferred, disclosed, traded, exchanged, or otherwise made available to any third party, affiliate, partner, co-marketer, data broker, list vendor, lead purchaser, or any other individual or entity, under any circumstances, for any purpose whatsoever. We do not purchase, rent, or acquire personal information from data brokers, list vendors, or any third-party lead generation sources for use in our SMS messaging program. SMS opt-in data is used solely and exclusively to send SMS messages from Emerald Coast Lifestyle LLC to the individual who expressly consented to receive those specific messages.
4.11 SMS Consent Record Retention
Emerald Coast Lifestyle LLC retains SMS opt-in consent records and all supporting documentation for a minimum of five (5) years from the date consent was obtained, as required to support compliance with TCPA recordkeeping obligations and carrier compliance requirements for A2P 10DLC messaging programs. SMS opt-out records, including the date and time of each STOP request received and processed, are retained permanently to ensure that opted-out mobile numbers are never reactivated without a new affirmative opt-in consent. 4.12 SMS Technology Platform
Emerald Coast Lifestyle LLC uses GoHighLevel as its primary SMS delivery and customer relationship management platform. SMS messages are transmitted through Twilio's cloud communications infrastructure, which serves as the underlying telecommunications delivery layer for messages sent via GoHighLevel. These service providers process mobile phone numbers and message content solely for the purpose of facilitating message delivery and are contractually prohibited from using this data for their own independent marketing or commercial purposes. 5. Prohibited Uses
You agree that you will use the Website only in accordance with all applicable federal, state, and local laws, rules, regulations, and these Terms at all times. THIS LIMITATION OF LIABILITY REFLECTS THE ALLOCATION OF RISK BETWEEN YOU AND EMERALD COAST LIFESTYLE LLC AS AGREED UPON IN THESE TERMS OF SERVICE. THE LIMITATIONS SPECIFIED IN THIS SECTION WILL SURVIVE AND APPLY EVEN IF ANY LIMITED REMEDY SPECIFIED IN THESE TERMS OF SERVICE IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.
